This privacy policy ("Privacy Policy") covers the Site http://www.nutriinfo.com (the "Site"). This Privacy Policy is incorporated into and subject to the terms of the "Terms of Use" for this Site. This Privacy Policy will fully disclose our policy about the collection, maintenance, use, disclosure, and security of personally identifiable information obtained from users of the Site. - OVERVIEW
Minu Interactive, Inc. ("Minu" or "we") provides the Nutriinfo system to both Web based individual consumers ("Consumer Users") and organizations using the Nutriinfo system for the benefit of their clients ("Commercial Users") (Consumer Users and Commercial Users collectively referred to and "Users"). Consumer Users will use the Nutriinfo system for the purpose of managing their diet, weight, and health. Commercial Users will use the Nutriinfo system for the benefit of their clients in assisting their clients to manage their individual diet, weight, and health. Minu collects information on Users only as necessary to provide these services or to perform research and analysis for the development of the services. This Privacy Policy applies to information which is identifiable of a specific individual such as a userâs name, address, e-mail address, telephone number, financial information or any other information that can be used to contact an individual ("Identifiable Information").
- INFORMATION COLLECTION AND USE
A. Information Collection: Minu is the sole owner of the information collected at the Site from the Users. Minu stores data on Consumer Users solely to provide services to them, to perform research and analysis for the development of the services, or to facilitate a Commercial Users providing services to its own clients as Consumer Users as set forth herein. Minu collects information from Users upon registration and at other points on the Site.
B. Registration: In order to use the services provided through the Site, a User must first complete the registration form. During registration a Consumer User will be required to give contact information (such as name, billing address, credit card information and E-mail address). Minu, or a Commercial User if applicable, may use this Identifiable Information to contact the Consumer User about services on the Site for which he or she has expressed interest. Subject to the terms of this Privacy Policy, Minu or the applicable Commercial User will return your Identifiable Information, and all copies thereof, within a reasonable time after your request. However, Minu may retain one (1) copy of all of your Identifiable Information solely for its own research, analysis and record keeping purposes. Minu will have no obligation or responsibility to return or provide any unidentifiable information to you.
C. Profile: We store information that we collect through cookies and log files to create a profile of our Consumer Users. A profile is stored information that we keep on individual Consumer Users that details their viewing preferences. Consequently, collected information is tied to the Consumer Userâs Identifiable Information to provide offers and improve the content of the Site. This profile is used to tailor a userâs visit to our Site, and to direct pertinent marketing promotions to them. We do not share User profiles with other third parties unless necessary to perform credit checks in compliance with applicable law. Then we may run a credit check with your Identifiable Information. Minu shall use Identifiable Information only in association with its operation and administration of the Site and its communications with its Users. Minu shall maintain the confidentiality of all Identifiable Information in the same manner in which it protects its own confidential information of like kind, but in no event shall Minu take less than reasonable precautions to prevent the unauthorized disclosure or use of your Identifiable Information. Minu may disclose your Identifiable Information to its employees and contractors on a need to know basis provided that such employees and contractors have confidentiality obligations to Minu. Minu may modify Identifiable Information such that it is not identifiable as belonging to a particular User("Modified Information"), and Minu may store, analyze, manipulate, aggregate, display, disclose, distribute, retain and otherwise use such Modified Information without restriction. Minuâs obligations under this Privacy Policy do not apply to any information or data that: (a) is not identifiable as yours; (b) is or becomes entirely in the public domain; (c) was known to Minu prior to its access to the information or data; (d) received lawfully from a third party through no breach of any obligation of confidentiality owed to you; and/or (e) created by Minu independently of its access to or use of your Identifiable Information.
D. Cookies: A cookie is a piece of data stored on a userâs computer tied to information about the user. We use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the userâs hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. By setting a cookie on the Site, users would not have to log in a password more than once, thereby saving time while on the Site. If users reject the cookie, they may still use the Site. The only drawback to this is that the user may be limited in some areas of the Site. Persistent cookies enable us to track and target the interests of our users to enhance the experience on the Site. E. Log Files: Like most standard Web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the Site, track userâs movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to Identifiable Information. We use a tracking utility called WebTrends Live that uses log files to analyze user movement. - COMMUNICATIONS FROM THE SITE
A. Special Offers and Updates: We send all new Consumer Users a welcoming E-mail to verify password and username. Established Consumer Users will occasionally receive information on products or services we offer. Out of respect for the privacy of all of our Consumer Users we present the option to not receive these types of communications. Please see the Choice/Opt-out section.
B. Service Announcements: On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance we might send Users an E-mail. Generally, Users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.
C. Customer Service: We communicate with Users on a regular basis to provide requested services and in regards to issues relating to their account we reply via E-mail or phone, in accordance with their wishes.
- INFORMATION SHARING
A. Legal Disclaimer: We may need to disclose Identifiable Information when required by law or to comply with a current judicial proceeding, a court order or legal process.
B. Research Purpose: To better serve the health needs of our Users and help them or their clients develop a healthy lifestyle for lifetime health, we may use Consumer Users' information (weight loss progress, logged information, Site use) for research purposes by Minu or the Applicable Commercial User and may provide Modified Information to Commercial Users other researchers. However, all the Modified Information is confidential, and will not contain Identifiable Information. The research will be reviewed by an Institutional Review Board or research center in advance, and the results may be shared with Users.
C. Third Party Intermediaries: We use a credit card processing company to bill Consumer Users for services. This processing company does not retain, share, store or use Identifiable Information for any secondary purposes.
D. Business Transitions: In the event Minu goes through a transition, such as a merger, acquisition by another company or a sale of its assets, Consumer Userâs personal information will, in most instances, be part of the assets transferred. Consumer Users will be notified via E-mail and/or prominent notice on the Site for thirty (30) days prior to a change of ownership or control of their personal information. If as a result of the business transition, the Consumer Userâs Identifiable Information will be used in a manner different from that stated at the time of collection, they will be given choice consistent with our notification of changes section.
E. Choice/Opt-Out: Our Consumer Users are given the opportunity to "opt-out" of having their information used for purposes not directly related to the Site at the point where we ask for their information. Consumer Users of the Site are always notified when their information is being collected by any outside parties. We do this so our users can make an informed choice as to whether or not they should proceed with services that require an outside party. Consumer Users should assume that their personal information is being collected by a third-party Commercial User if they are receiving the services through a program associated with a third party. Consumer Users should review the privacy policy of any such third-party Commercial Users as to how such third party collects, maintains uses, discloses, and secures personally identifiable information obtained from such a program. Please be aware that Minu is not responsible for the privacy practices of third-party Commercial Users
F. Links: This Site contains links to other sites. Please be aware that Minu is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave the Site and to read the privacy statements of each and every Web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by this Site.
G. Security: The security of this Site, and of the servers and other computer equipment used to bring you this Site, is a high priority of Minu. We maintain this Site and all associated data with technical, administrative, and physical safeguards to protect against loss, unauthorized access, destruction, misuse, modification, and improper disclosure. We follow industry-proven security procedures such as encrypted administrative communication, restricted access to underlying machines, and firewalls at network access points. No computer system or information can ever be fully protected against every possible hazard. All employees are kept up-to-date on our security and privacy practices. Any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our usersâ Identifiable Information is protected. Finally, the servers that store Identifiable Information are in a secure environment and information is moved offline on a regular basis. Identifiable Information is shared only with the Consumer User that provided us the Identifiable Information to begin with.
H. Correcting/Updating/Deleting/Deactivating Personal Information: If a Consumer Userâs Identifiable Information changes (such as zip code, phone, E-mail or postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate that Identifiable Information. This can usually be done at the My Account page.
I. Notification of Changes: If we decide to change our Privacy Policy, we will post those changes to this Privacy Policy on our homepage, and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. You are responsible for regularly reviewing this Privacy Policy and all such changes. Continued use of the Site after any such changes have been posted shall constitute your agreement to such changes. We will use information in accordance with the Privacy Policy under which the information was collected.
J. HIPPA-Compliance: In the event the information collected from you, or the services we provide for or to you, would result in the application of HIPAA, we shall comply with the privacy and security rules of HIPAA. You may request a copy of our HIPAA privacy policy at support@nutriinfo.com.
